Terms

These terms cover the Hope Creative app (the free version), Hope Creative Studio, your account and this website. They are offered by Hope Studios (“we”, see the imprint). By installing or using the app you agree to them.

1. Buying Studio

Hope Creative Studio is sold by our reseller Paddle.com Market Limited. Paddle is the merchant of record for all our orders: your purchase contract is with Paddle under its Buyer Terms, and Paddle takes care of payment, invoices, taxes and refunds. Prices are one-time prices and include VAT where it applies. You can find your orders at paddle.net.

You can get your money back within 14 days of your purchase, without giving a reason; see theRefund Policy. The license itself, what you may do with the software, is granted by us under these terms.

2. Your license

Hope Creative Studio

• You may use Studio on up to 2 computers at the same time, macOS or Windows in any mix.
• The license does not expire. Updates we release are included at no extra cost for as long as we offer them for free.
• You may use it for personal and commercial work.
• Studio is activated with your license key. You can deactivate a computer in the app or in your account and activate another one instead.
• Studio checks the license with our server when it starts. Without an internet connection it keeps working for 30 days after the last successful check; after that it needs to be online once to continue.

Hope Creative (free version)

• You may use the free version on any number of computers, for personal and commercial work, at no cost.

For both

• The license is personal and cannot be transferred to someone else. You may not share, sell, rent or lend your license key or the software.
• You may not get around the license check or remove copyright notices.
• You may not decompile or reverse engineer the software, except where the law expressly allows it (§§ 69d, 69e of the German Copyright Act).

3. Suspending or ending a license

We may suspend or switch off a license or an account, as far as is reasonable in the case, if:

• a purchase is refunded, a payment is charged back or not made, or the payment was fraudulent;
• the license key is shared, sold or published, or the license check is worked around;
• there is a security risk, for example a key that has become public or an account that has been taken over;
• these terms are breached in another serious way.

Where it makes sense, we tell you first and give you the chance to put it right; a key that has become public we replace with a new one. Your projects are never affected: they stay yours and open in the free version.

4. Your work

Everything you make with Hope Creative is yours: projects, renders and exports. We claim no rights to it. Footage, fonts, plug-ins, models and other material you bring in keep their own licenses; you are responsible for having the rights to use them. Third-party components included in the app, such as AI models, are listed with their licenses in the app under Tools ▸ Third-Party Licenses.

5. Online services

Activation, the license check, update notices, your account and downloads depend on our servers. We keep them running with care, but we do not guarantee that they, or the app, work without interruption or without errors. If the license server can't be reached, an activated Studio keeps working for 30 days.

6. Warranty

If you are a consumer, the statutory rules for digital products apply (§§ 327 ff. of the German Civil Code). The software comes as it is at the time of your purchase; we fix defects with updates. Please keep backups of your projects: like any software, Hope Creative can contain errors.

7. Liability

We are liable without limit for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only if we breach an obligation that is essential for the contract, and then only for the damage that is typical and foreseeable for this kind of contract. Otherwise our liability for slight negligence is excluded.

8. Law and jurisdiction

German law applies, without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection of the country you live in stays in force. For merchants, the place of jurisdiction is Braunschweig, Germany.

9. Changes and the rest

We may update these terms when the software or our services change; changes do not take away rights you already have for a purchase. If one part of these terms is invalid, the rest stays valid. Questions?
